These Terms govern your access to and use of www.aveoearth.com and associated applications, operated by AveoEarth Impact Private Limited.

1. Marketplace Role & Contract

1.1 AveoEarth operates as an online marketplace platform facilitating transactions between independent third-party sellers (“Sellers”) and customers.

1.2 AveoEarth operates as an intermediary marketplace in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

1.3 Your purchase contract is directly with the respective Seller. AveoEarth is not the seller of record unless expressly stated (for example, where a product is marked “Sold by AveoEarth”).

1.4 AveoEarth provides technology infrastructure, payment facilitation, order routing, customer support, and dispute facilitation.

1.5 Unless expressly stated, AveoEarth does not assume product liability, statutory warranty obligations, or seller compliance responsibilities.

2. Eligibility & Account

2.1 You must be at least 18 years old and legally competent to enter into binding contracts.

2.2 You are responsible for safeguarding your account credentials and all activity under your account.

2.3 AveoEarth may suspend or terminate accounts for fraud, abuse, policy violations, or legal non-compliance, subject to applicable law.

3. Listings, Pricing & Taxes

3.1 Listings, descriptions, sustainability claims, pricing, taxes, and availability are provided by Sellers unless otherwise stated.

3.2 In case of a bona fide and obvious material error in price or description, the Seller or AveoEarth may cancel the order and issue a refund.

3.3 Taxes are applied in accordance with applicable GST and statutory regulations.

4. Orders & Acceptance

4.1 Order confirmation is an acknowledgement of receipt only. Acceptance occurs upon dispatch or digital/service fulfilment.

4.2 Orders may be cancelled due to fraud suspicion, stock unavailability, regulatory restrictions, force majeure, or as required by law.

5. Payments

5.1 Payments are processed through RBI-regulated payment aggregators or banking partners.

5.2 AveoEarth does not store full card details. Card tokenisation complies with RBI norms.

5.3 Refund timelines depend on payment network and issuing bank rules.

6. Delivery & Risk

6.1 Delivery is performed by Sellers or logistics partners.

6.2 Risk of loss passes upon delivery as defined in the Shipping & Delivery Policy; however, this does not affect any non-excludable statutory rights under applicable consumer protection laws.

6.3 In case of confirmed non-delivery attributable to Seller fault, refund or replacement shall be processed in accordance with the Refunds & Cancellations Policy.

6.4 AveoEarth is not liable for logistics delays beyond reasonable control.

7. Returns & Refunds

7.1 Returns and refunds are governed by the Refunds & Cancellations Policy.

7.2 Nothing in this Policy limits statutory consumer rights under applicable law.

8. Sustainability & Environmental Claims

8.1 Sustainability, carbon, environmental, ESG, or impact-related claims are provided by Sellers or generated using internal or third-party methodologies.

8.2 Such claims are indicative assessments based on available data and may rely on Seller-provided information and third-party datasets.

8.3 Unless expressly certified, AveoEarth does not independently audit or warrant all sustainability representations.

8.4 Sellers remain solely responsible for the accuracy, substantiation, and legal compliance of sustainability-related claims.

8.5 Nothing in this section limits statutory consumer protections relating to misleading advertisements or unfair trade practices.

9. Platform Availability

9.1 The Platform is provided on an “as available” basis.

9.2 We do not guarantee uninterrupted, secure, or error-free operation.

9.3 AveoEarth is not liable for outages caused by third-party infrastructure, cyber incidents, or force majeure events, subject to applicable law.

10. Intellectual Property & Takedown

10.1 All Platform content, software, trademarks, and materials belong to AveoEarth or its licensors.

10.2 If you believe content infringes intellectual property rights, contact support@aveoearth.com for review and takedown.

11. User Conduct

You agree not to:

  • Post unlawful, misleading, or defamatory content
  • Upload counterfeit or infringing listings
  • Circumvent security measures
  • Scrape or extract data without authorization
  • Engage in fraudulent returns or chargebacks

12. Warranty Disclaimer

Except as required by law, the Platform is provided “as is.”

Sellers are responsible for product warranties and statutory obligations.

Nothing excludes warranties or liabilities that cannot be excluded under applicable law.

13. Limitation of Liability

13.1 To the maximum extent permitted by law, AveoEarth shall not be liable for indirect, incidental, special, consequential, or punitive damages.

13.2 Aggregate liability shall not exceed the amount paid for the relevant order giving rise to the claim.

13.3 Nothing excludes liability that cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold harmless AveoEarth from claims arising out of:

  • Your breach of these Terms
  • Fraudulent activity
  • Violation of applicable law
  • Misuse of the Platform

This indemnity applies to the extent permitted by applicable law.

15. Force Majeure

AveoEarth shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, regulatory actions, strikes, infrastructure failures, or cyber incidents.

16. Governing Law & Dispute Resolution

16.1 These Terms are governed by the laws of India.

16.2 Courts at Noida, Uttar Pradesh shall have jurisdiction, subject to statutory consumer remedies allowing customers to approach appropriate consumer forums under applicable law.

17. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:
